How to Evict Nuisance and Anti-Social Tenants
Although the majority of tenants are likely to keep to their rental obligations, there are tenants who will cause a nuisance, whether this is property damage, excessive noise, anti-social behaviour, uncontrolled dogs, gathering youths, sub-letting (over-crowding), drug use, or a general disruption to the neighbours.
Nuisance tenants leave the landlord in a position of having to decide whether to give the nuisance tenants time to clean up their act, or commence the procedure of eviction straight away. If after giving them a reminder of their responsibilities by making use of our effective pre court action letter the situation does not improve, then the next step is to start formal eviction proceedings.
Evictions SouthEast are able to offer a Platinum Service whereby they obtain a court hearing date within 48 hours. This can greatly reduce the stress and uncertainty facing landlords with nuisance tenants.
Dealing with the Nuisance Problem
Evictions South East can manage this whole process for you, by firstly issuing a formal letter of notice to evict the tenant(s). The document issued will be referred to under the title of section 8 eviction notice on occasions where the tenancy agreement hasn't yet drawn to an end. It will be written in accordance with the law and in terms that each tenant can fully understand, as well as detailing the nuisance, antisocial behaviour, excessive noise, disputes with neighbours, dog noise and fouling - issues, it can also include grounds such as rent arrears, subletting without consent or property damage.
However, it is worth noting that a notice related to rental arrears will come into effect once the tenant has two months of rental arrears.
How Long it Takes to Evict Nuisance Tenants
The amount of time that it takes to evict nuisance tenants is one of the major gripes of many rental property owners. In an ideal world landlords want (need) to quickly resolve a matter where the tenant completely neglects their responsibilities. However, under section 8 it is necessary to set a date for a court hearing in which the arguments of each party will be set forth.
Landlords acting on their own behalf may have to wait some time for the case to be heard, where as Eviction South East clients can benefit from access to our fast access to a 48 hour court hearing date, which is very helpful when a fast tenant eviction is required.
Court Proceedings Against Nuisance Tenants
Landlords who employ the services of eviction specialists such as Evictions South East may be given the opportunity of a quicker hearing. They will readily craft a professional letter which can be used as legal evidence, if so required. We can also offer court room support, providing the landlord with far greater confidence than if they had presented the case to the judge by themselves.
Dealing with Tenants Who "Play the System"
Some landlords need all the help and experience that they can get to evict their nuisance tenants. Even those who have been through an arduous court case may require the assistance of bailiffs to remove a particularly stubborn tenant.
Thankfully the provision of such experts can also be dealt with by Evictions South East who are experts in evicting problem tenants – even those who seemingly known exactly how to “play the system” with the aim of staying in the property for as long as possible, all to often withholding or refusing to pay the rent.
However, it is important to note that there are instances where the tenant will be allowed to remain at the property, provided that they meet discretionary grounds. This is more likely to happen if you are unsure of the law or do not have specialist legal advice, at Evictions SouthEast we will ensure your case is water tight.
Some landlords are unfortunate enough to have tenants who are all too likely to understand and exercise their own rights when it comes to staying in rental accommodation, whilst also dodging their own responsibility towards the landlords. As one industry expert said, “It is shocking how tenant protection is taken much more seriously than that of the residential landlord, and landlords who are not adequately protected ... could find themselves seriously out of pocket.”
